Terms and Conditions

  1. The person whose signature appears on the site contract is deemed to have read and agreed to abide by these conditions governing the conduct of the FNQ Rotary Field Days and hereby declares his or her authority to sign on behalf of his or her employer company (if applicable).
  2. The site contract, signed by the exhibitor must be in the hands of the secretary of the FNQ Rotary Field Days Committee Inc. (hereinafter referred to as the Secretary), by 13 May, 2009.
  3. The Rotary Clubs of Mareeba and Atherton as promoters of the FNQ Rotary Field Days (hereinafter referred to as the field days) shall not be held liable for the loss or damage to the exhibitors’ property whilst on the field days ground.
  4. The exhibitor will accept the site allocated by the committee but every effort will be made where practical to allocate the desired space to exhibitors.
  5. A cheque covering the total participating costs or the balance due must be enclosed with the completed site contract or if booked on line payment must be received within 10 working days.
  6. Except with the written consent of the Secretary, the exhibitor shall not assign, sublet or part with possession of the whole or any of the site or purport to do so.
  7. If the committee shall find it necessary or expedient to cancel or postpone the field days this contract will cease to operate, upon notice to that effect, signed by the Secretary being served on the exhibitor or at the option of the committee by handing or offering to any person who appears or is thought by the Secretary to be an employee, agent or partner of the exhibitor and the committee shall not be liable to the exhibitor for any compensation, whether on the grounds of loss of profits or otherwise in respect of such cancellation or postponement.
  8. If the exhibitor, not less than two weeks prior to the start of the field days, requests the committee to cancel this contract the committee may do so on the condition that it retains 25 per cent of the amount mentioned in this contract. If the exhibitor makes similar request within two weeks the committee may cancel this contract but without prejudice to its right under paragraph 9 below.
  9. The committee reserves the right to cancel the contract and to retain all moneys paid in relation to it if there is in the opinion of the Secretary or other person appointed by the committee any infringement of any of the conditions and/or if the exhibitor does not occupy the site at the start of and during the full period of the field days.
  10. Exhibitors shall conform with the requirements of any act of parliament which may govern the erection of structures, the display and/or sale of machinery and other products and goods.
  11. The committee reserves the right to refuse permission for the erection of any building or structure or the drilling or digging of any bore, well or hole or the positioning of tent pegs or the like, without due regard to the proximity of water and power services on the field days grounds and the safety of others.
  12. All costs involved in any repair to services will be directly recoverable from the exhibitor at fault or their employees.
  13. The use of amplifiers or loud speakers by exhibitors is strictly prohibited.
  14. All vehicles not being part of your exhibit must be removed from the grounds before 8:30 am on both Wednesday and Thursday (or may be towed away). Exhibitors may not bring or permit any vehicle to be brought into the grounds during the field days without the specific permission of the committee.
  15. The period of the field days is from 9am to 6pm Wednesday and Thursday. For the benefit and safety of public, no machinery, vehicles or goods or other articles displayed, shall be removed from the grounds before 4p.m. on Thursday.
  16. Exhibitors are requested to give purchasers of goods a document of proof of ownership (receipt or invoice) to be presented if required to the security officers or gatekeeper.
  17. The exhibitor shall not conduct or allow to be conducted on this site, any competition, raffle, art union or game not approved in writing by the Secretary.
  18. Displays must be ready no later than 9am on the first day and shall not be dismantled before 4pm on the final day.
  19. No livestock other than those approved by the committee shall be brought onto the grounds.
  20. The dropping of advertising leaflets or other similar material from aircraft above the field days site and the display of signs, placards or advertisements in locations other than the space covered by this contract or by other written agreement with the Secretary is prohibited.
  21. The exhibitor will have to advise full details of their Public Risk Insurance prior to being admitted to the site.
